Alcohol, Drugs, and Driving

DUI is one of the most serious offenses you can commit on the road. In Florida, the penalties are severe — and they start at your very first offense.

Blood Alcohol Content (BAC) Limits

In Florida, the legal BAC limit is 0.08% for drivers 21 and older. For drivers under 21, the limit is 0.02% — essentially zero tolerance. For commercial vehicle drivers, the limit is 0.04%. BAC is affected by body weight, how much you ate, how fast you drank, and your gender. There is NO safe amount of alcohol before driving. Even one drink can impair your reaction time and judgment.

Implied Consent Law

By driving in Florida, you have already "consented" to a breath, urine, or blood test if an officer suspects you of DUI. This is called implied consent. If you refuse the test: first refusal = 1-year automatic license suspension. Second refusal = 18-month suspension AND a misdemeanor criminal charge. Refusing does NOT prevent you from being charged with DUI — officers can still arrest you based on other evidence.

DUI Penalties

First offense: up to $1,000 fine, up to 6 months in jail, 180 days to 1 year license revocation, 10 days vehicle impoundment, possible ignition interlock device. Second offense: up to $2,000 fine, up to 9 months in jail, mandatory ignition interlock for at least 1 year. Third offense within 10 years: FELONY, up to $5,000 fine, up to 5 years in prison, 10-year license revocation. BAC of 0.15% or higher: enhanced penalties at every level.

Drugs and Driving

DUI applies to ALL impairing substances — not just alcohol. Marijuana, prescription medications, over-the-counter drugs that cause drowsiness, and illegal drugs can all result in a DUI charge. "I have a prescription" is not a defense if the drug impairs your driving. If a medication label says "may cause drowsiness" or "do not operate heavy machinery," don't drive after taking it.

💡 You go to dinner and have two glasses of wine. You feel "fine." But your BAC is 0.06% — below the legal limit but enough to slow your reaction time. You rear-end a car at a stoplight because you reacted a half-second too late.
💡 A friend takes prescription pain medication before driving. They get pulled over for weaving and fail a field sobriety test. They are charged with DUI even though they had zero alcohol — the prescription drug impaired their ability to drive safely.
